Meanwhile, Mr Justice Rimita upheld an eight year jail term which was imposed on a man who pleaded guilty to the charge of rape by the Nyahururu Principal Magistrate's court.

Mr Samuel Njau Mbiu was convicted of the charge of rape on his own plea of guilty by the then Nyahururu Principal Magistrate Wanjiru Karanja on October 3, 1997.

The appellant who had appealed against both conviction and sentence was also ordered by the lower court to receive eight strokes.

Mr Mbiu was charged that on January 25, 1997 at Miharati area of Nyandarua district jointly with others not before the court broke into the complainant house and raped her in turns.

Yesterday, Mr Justice Rimita said that from the records of the lower court it was evident that the appellant admitted the facts of the case.

The judge said that the facts which were read to the accused person by the prosecutor disclosed the offence he was charged with.

While dismissing the appeal, Mr Justice Rimita said that the sentence of eight years and eight strokes which was imposed on the appellant was safe.

[Teenage robber gets jail and cane]

Meanwhile, a teenager who robbed a woman of Sh170 was yesterday jailed for four years and ordered to receive four strokes of the cane by a Mombasa court.

Ndegwa Yawa, 19, was sent to jail by a Mombasa Senior Resident Magistrate Beatrice Maloba after he admitted a charge of robbery.

He was accused of robbing Ndunge Lucia of a handbag containing Sh170 on December 17 at Timbwani, jointly with others not in court.

The prosecutor, Insp Morris Wafukho told the court that on the day in question Lucia, a maid, was going home from her place of work when she was mugged by two suspects.

He said while ahead of the woman they stopped and attacked her and snatched the bag from her. Living leaving her lying on the ground.

The prosecutor said the complainant shouted for help and members of the public responded by chasing the accused and arrested him the bag and the money were recovered.
