Youth gets jail, rotan for incest

IPOH, Mon. — For subjecting his eight- year-old sister to the trauma of incest, an 18-year-old youth was today sentenced to eight years’ jail and ordered to be given three strokes of the rotan by the Sessions Court. The youth had pleaded guilty to three counts of committing incest with his youngest sister, then six years old, at their family home in Kuala Dipang between noon and 5pm between January and December 2002, between January and December last year, and between January and July this year.

"However remorseful the brother is for having committed the despicable offence, the fact is he has ruined his sister's life and innocence," said deputy public prosecutor Muhamad Anas Mahadzir.

Anas said such was her ordeal that instead of relating the crime either to her father, 49, or her eight older siblings, the victim had confided her anguish to her school teacher. The teacher then reported the case to the Social Welfare Department.

The girl's mother died two years ago and the brother had begun the incestuous assaults in 2002.

"He would commit his despicable act whenever there were no family members around," Anas said, adding that the only other person present in the house then was the sister's younger friend. Seeking a custodial sentence, he said it was inadequate to let the accused off by only sending him to the Henry Gurney School in Malacca.

He said a custodial sentence should be handed down so that the accused would be kept away from the victim for a longer period.

Sessions judge Rashidah Chik sentenced the youth to eight years’ jail for each count and three strokes of the rotan. The jail terms run concurrently from the date of his arrest on Sept 14.

Earlier, in another court here, the same youth was ordered by Sessions Judge Ahmad Nasfy Yasin to serve three years at the Henry Gurney School after he admitted to raping his sister's friend, seven, at the same place and time between January 2002 and January last year.

Pinoy migrants used by Malaysian politicians to vote during elections

ZAMBOANGA CITY, November 11, 2004 (STAR) By Roel Pareño - Filipino illegal immigrants are being used by Malaysian politicians to vote during elections, a deportee sent home from Sabah said yesterday.

Marcelino Fuesillero, 60, said he was able to vote in three Malaysian elections during the 1990s before he was arrested for illegal entry.

The deportees, or "halaw," also denounced how they continued to be mistreated by Malaysian authorities despite protests from Manila.

"What came out in the media and in their newspapers were not true, it was just flowery words. They still kick us inside the confinement centers in Tuwaran, Kota Kinabalu," Fuesillero said.

He said he could not even answer the call of nature because he feared if he asked permission to use the restroom, he would be kicked or hit by the guards.

"So I have to use plastic and pee in it," he said. "Where is the human rights there? We are supposed to adhere to the international conventions of human rights law."

The deportees also confirmed that most of them received the punishment of caning from Malaysian authorities.

Benson Mejada, 28, said all those caught with expired passports and illegally staying in Sabah, Malaysia, are to receive one strong lash using the rattan.

Mejada, from Taytay, Rizal, said those who were caught to have illegally entered the country receive two or more lashes. "It's not true that we Filipinos are not maltreated. There are even sick deportees detained together with us," he said.

The Crisis Intervention Unit of the Department of Social Welfare and Development in Western Mindanao headed by Agapita Bendoi assisted the deportees before they were sent back to their places of origin in the Philippines.

Security guard jailed, whipped for raping 10-year-old girl

MIRI - A 25-year-old school security guard was sentenced to a total of 24 years' jail and 12 whippings for raping a 10-year-old student on two counts, excluding other times since June this year.

Peter Jong of Rumah Ngau Ajang Long Bemang, Tutoh/Apoh Baram District faced two charges of raping the girl.

The jail term of 12 years plus six whippings for the first charge and the same for the second charge, was to run consecutively.

The Sessions Court was told the first rape happened sometime in June while the girl was watching television at the school hall when the accused invited her out.

The girl was then raped behind the dining hall of SK Long Bemang.

The Primary Four girl, frightened of the guard who warned her not to reveal the ordeal, had been raped repeatedly since June, mostly after her evening classes until she managed to lodge a police report at Marudi on Oct 22.

The guard who had escaped from the school was arrested on Oct 24 at Long Bedian.
