Four Plead Guilty To Firearms Possession

Bandar Seri Begawan - Two stateless Iban men aged 19 and 29 years were sentenced to one year imprisonment and three strokes of the cane while another two stateless Iban youths aged 17 and 13 were both released on 12-month bonds for good behaviour by the Bandar Magistrates' Court yesterday, after the defendants pleaded guilty to a joint charge of having in their possession one home made rifle.

The defendants, Senaun Anak Jumat, 19, Mohd Alip bin Abdullah William, 29, Mohd Azman bin Abdullah Jumat, 17, and the 13-year-old youth, who are self employed working at their padi field, pleaded guilty to having in their possession the said offensive weapon on or about March 2 this year.

The court heard that the said weapon was found by CID police and the Immigration authorities inside a white Toyota Cressida after stopping the car in the vicinity of Kampong Melayan, Labi Kuala Belait as it was coming out from a small road junction at the Kg Melayan longhouse, which is a public place.

DPP Dk Hjh Hana Molina further told the court that one barrel and one piece of metal, thirteen bullets, eleven tin pellets, one metal polish, one black bag, one lantern, two knives, one helmet and two plastic boxes containing one lantern were found together with the weapon.

According to the prosecutor, the homemade rifle which is capable of firing a projectile that could be considered lethal, belonged to the defendants and was used by them to scare off wild animals which enter their padi field.  -- Courtesy of Borneo Bulletin

15 Years And 10 Strokes For Syabu

Bandar Seri Begawan - A 34-year-old Bruneian was sentenced to 15 years' imprisonment and 10 strokes of the cane by the High Court yesterday after he pleaded guilty to nine counts under the Misuse of Drugs Act.

The defendant, Pg-Safaruddin bin Pg Hj Beswani, who has previous convictions under the same act, pleaded guilty to having in his possession 32.881 grammes of a Class A controlled drug, Methylamphetamine, or locally known as Syabu, for the purpose of trafficking, four counts of consuming Syabu, having in his possession 3.306 grammes and 8.6 grammes of the drug respectively, and to two counts for having in his possession utensils for consumption of the controlled drug.

22 years behind bars for cannabis

A Chinese man was sentenced to 22 years imprisonment and 15 strokes of the cane by the High Court yesterday after he was found guilty of two charges of trafficking cannabis totalling 444.448gm.

The defendant, Chiang Chee Yee who was represented by Counsel Mr Hj Zul-Sukarla was first convicted for having in possession for the purposes of trafficking 415.335gm of cannabis on Oct 23, 2003. He was sentenced to 22 years and 15 strokes for that offence.

Meanwhile, the defendant was sentenced to 4 years and 4 strokes on a second charge for having in possession for the purposes of trafficking the same drugs weighing 29.113gm on Oct 24 the same year. However, Judge Datin Paduka Hjh Hayati ordered for the sentences to run concurrently.

In sentencing, Judge Datin Paduka noted that possession of 600gm for the purposes of trafficking attracts the death penalty. In law, possession of 400-600gm attracts the minimum of 20 years and 15 strokes, a maximum 30 years.

She took into account the not guilty plea, the amount of drugs and the minimum penalty imposed before passing the sentence. More than 15 witnesses were called in by the prosecution led by Deputy Public Prosecutor Pg Nina Jasmine during the trial.

Jail, Whipping For Overstaying Foreigners

Bandar Seri Begawan – Two foreigners were sentenced to jail and whipping by the Bandar Magistrate's Court yesterday after both pleaded guilty to their respective charges under the Immigration Act.

Indian national HakeemuddinAzmi, 36, was sentenced to six months' jail and three strokes of the cane for overstaying in Brunei for five years and two months with an expired employment pass.

Meanwhile, Bangladeshi national Mahbub Alam Siddique Howlader, 34, was sentenced to four months' jail and three strokes of the cane for remaining in the country with an expired special pass.

The court heard that Hakeemuddin was arrested two days ago at the vicinity of the Immigration building, while Mahbub was arrested at a house in Kg Jerudong yesterday. Both were arrested by Immigration Enforcement officers. -- Courtesy of Borneo Bulletin
